Terms of Service

These terms govern your use of Draft Nirvana and its draft room applications, including draftspeakeasy.com and drafttavern.com (collectively, the “Service”), operated by Draft Nirvana LLC, a Delaware limited liability company (“we,” “us,” “our”). By checking the acceptance box and entering a draft room, you agree to these terms. If you don’t agree, don’t enter.

What the Service Is

Draft Nirvana is a live draft venue for fantasy sports leagues. We provide the room — video, audio, a draft board, a pick timer, and the ceremony. We do not provide player rankings, trade advice, or fantasy content. We do not operate daily fantasy sports contests. We do not accept wagers, offer prize pools, or take a percentage of league buy-ins. If your league has a buy-in, that’s between you and your league. We facilitate the draft experience; we are not a party to your league’s financial arrangements.

How You Get In

Access to a draft room is by invitation only. Your league’s commissioner adds you, and you receive a PIN — either by email or directly from your commissioner. Your PIN is your key. Don’t share it with anyone outside your league. If your PIN is compromised, contact your commissioner to have it reissued. We are not responsible for unauthorized access resulting from shared PINs.

Your Account

Draft Nirvana uses passwordless authentication. There is no username/password account. Your PIN, combined with the name and email provided by your commissioner, is your identity in the system. You are responsible for the accuracy of the information your commissioner provides on your behalf and for any activity that occurs under your PIN.

Acceptable Use

You agree to use the Service for its intended purpose: participating in fantasy sports drafts with your league. You will not attempt to disrupt other users’ draft experience, use automated tools or bots to make picks, attempt to access draft rooms you haven’t been invited to, reverse-engineer, scrape, or probe the Service’s infrastructure, or use the Service for any unlawful purpose.

Because Draft Nirvana is a live, social space with video, audio, and chat, we also expect you to treat the people in the room like people. Don’t harass, threaten, stalk, or bully anyone. Don’t use hate speech, and don’t share content that’s obscene, defamatory, or illegal. Don’t post other people’s private information, and don’t impersonate someone else. Trash talk is part of a good draft — cruelty and abuse are not, and we trust you to know the difference.

We reserve the right to suspend or terminate access to anyone who violates these terms, at our sole discretion and without prior notice.

Reporting a Problem and Moderation

If someone in your draft crosses a line, tell us. Email legal@draftnirvana.com with what happened, and we’ll look into it. Depending on the situation, we can remove content, mute or remove a participant, suspend a PIN, or shut down a draft room.

A few honest limits. Our video and audio are live and in real time, so we can’t pre-screen what people say or do the way a platform built around recordings can. We don’t monitor every draft, and we’re not obligated to. What we can do is act on reports and on anything we do see. Your commissioner runs the room and is your first line; we’re right behind them.

Video and Audio

The Service uses live video and audio streaming so league members can see and hear each other during the draft. By default, this stream is real time only — we don’t record, store, or review the video or audio from your draft.

There is one exception. Some drafts — a beta draft, or a draft we’ve arranged to capture — are recorded. When that’s the case, you’ll be told before you enter and asked to agree separately, and that consent covers only the specific draft it’s shown for. You are responsible for your own conduct on camera and on microphone. If your league chooses to record the draft using its own third-party tools, that is your league’s decision and responsibility, not ours.

Intellectual Property

The Service — including its design, branding, code, and ceremony elements — belongs to Draft Nirvana LLC. Your league’s team names, logos, and inside jokes belong to your league. We claim no ownership over your league’s content. You grant us a limited license to display your league’s content within the draft room for the purpose of running your draft.

Copyright and Takedowns

You’re responsible for the content you bring into a draft — your team name, your logo, a walk-up song, anything you upload or share. Only bring content you actually have the right to use.

If you believe something on the Service infringes your copyright, send a notice to our copyright agent at legal@draftnirvana.com. Include enough detail for us to find the content, your contact information, and a statement that you have a good-faith belief the use isn’t authorized. We respond to valid notices consistent with the Digital Millennium Copyright Act (DMCA), we remove infringing content, and we end access for anyone who infringes repeatedly.

No Warranties

The Service is provided “as is” and “as available.” We do our best to keep draft night running smoothly, but we cannot guarantee uninterrupted service, perfect video quality, or that your league-mate won’t draft your player. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Interacting with Other Users

Draft Nirvana connects you with other real people — your league-mates, and sometimes people you’re meeting for the first time — over live video, audio, and chat. That’s the whole point, and it’s mostly a good time. But we don’t control how other people behave, and we can’t guarantee everyone will be on their best behavior.

You interact with other users at your own risk. We are not responsible for what other participants say or do, on camera or off, during or after a draft. A dispute between you and another user is yours to resolve. We’ll help where we reasonably can — see Reporting a Problem — but we’re a venue, not a referee for every disagreement.

Limitation of Liability

To the fullest extent permitted by law, Draft Nirvana LLC, its founders, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, lost draft picks, missed selections due to connectivity issues, or hurt feelings when someone takes your sleeper pick. Our total liability for any claim related to the Service will not exceed the amount you paid us in the twelve months preceding the claim — which, during our free tier, is zero.

Dispute Resolution

If you have a dispute with us, we’d prefer to resolve it by talking. Contact us first at legal@draftnirvana.com.

If we can’t work it out informally, you agree that any dispute, claim, or controversy arising from or relating to the Service or these terms will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Delaware. The arbitrator’s decision will be final and binding.

There are two exceptions. First, either party may bring a claim in small claims court if the claim qualifies (under $10,000). Second, either party may seek injunctive relief in court for intellectual property violations.

You agree to resolve disputes on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

This agreement is governed by the laws of the State of Delaware.

Changes to These Terms

We may update these terms. If we make material changes, we’ll notify you by email or by a notice in the draft app before the changes take effect. Your continued use of the Service after the effective date of updated terms constitutes acceptance. If you disagree with the changes, stop using the Service.

Age Requirement

You must be at least 18 years old to use the Service. By accepting these terms, you confirm that you are 18 or older. If we learn that someone under 18 has accessed the Service, we will terminate their access and delete their data.

Termination

You can stop using the Service at any time. We can terminate or suspend your access at any time, for any reason, with or without notice. Upon termination, your right to access draft rooms ends immediately. Provisions that should survive termination — including limitation of liability, dispute resolution, and intellectual property — will survive.

Advertising and analytics. We use third-party advertising and analytics technologies on our website, described in our Privacy Policy. By using the site you acknowledge those practices, including our use of cookies and pixels and the choices available to you.
